Terms of Service

Welcome to AviaSkill. By accessing or using our aviation exam preparation platform and free aviation tools (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Service.

These Terms constitute a legally binding agreement between you and YMI Digital LLC, operating as AviaSkill ("we," "us," or "our"). These Terms work alongside our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Cancellation & Refund Policy, all of which are incorporated by reference.

What AviaSkill Provides

AviaSkill is an online platform for aviation exam preparation and pilot education. Our Service includes:

Exam Preparation (subscription required)

• FAA knowledge test practice questions and study materials
• AI-powered explanations for every question
• Smart study modes with adaptive question selection
• Full-length exam simulations matching FAA format
• Progress tracking and readiness analytics
• AI chat tutor for aviation topics
• FAA source material references (Pilot's Handbook of Aeronautical Knowledge)

Currently Supported Certifications

• Private Pilot License (PPL) — FAA PAR exam
• Instrument Rating (IFR) — FAA IRA exam
• Additional certifications (Commercial, CFI, ATP) coming soon

Free Aviation Tools (no account required)

• Crosswind calculator, METAR/TAF decoder, unit converter, and additional tools
• These tools are free for everyone and do not require registration

Who Can Use AviaSkill

To use AviaSkill, you must:

• Be at least 13 years old (16 in jurisdictions where GDPR applies)
• Have parental or guardian consent if you are under 18
• Not be barred from using the Service under applicable law

For reference, the FAA requires student pilots to be at least 16 years old to obtain a Student Pilot Certificate, and at least 17 for a Private Pilot Certificate.

By using our Service, you represent that you meet these requirements.

Your Account

Account Creation

To access paid features, you must create an account by providing accurate, current, and complete information, including a valid email address and secure password. You may also sign in using Google OAuth.

Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at support@aviaskill.com if you suspect unauthorized access
• Keeping your account information accurate and up-to-date

We are not liable for any loss arising from unauthorized use of your account.

One Account Per Person

Each person may maintain only one AviaSkill account. Creating multiple accounts to circumvent trial limits, referral caps, or other restrictions is a violation of these Terms and our Acceptable Use Policy.

Account Deletion

You may delete your account at any time from Settings > Account. When you delete your account:

• Your personal data will be deleted within 30 days
• Your active subscription (if any) will be cancelled
• Your study progress, bookmarks, and chat history will be permanently removed
• Anonymized analytics data may be retained
• This action cannot be undone

Subscription & Billing

Subscription Plans

AviaSkill offers the following options:

All paid plans include identical features. Pricing is in US dollars and may be subject to applicable taxes.

Free Trial

• New users receive a 7-day free trial with full access to all Pro features
• No payment method is required to start the trial
• The trial automatically expires after 7 days
• One free trial per person — creating multiple accounts to extend trials is prohibited
• After the trial, you must subscribe to a paid plan to continue accessing exam preparation features

Billing and Payments

• All payments are processed securely through Stripe (PCI DSS Level 1 compliant)
• Subscriptions automatically renew at the end of each billing period unless cancelled
• You authorize AviaSkill to charge your payment method for recurring subscription fees
• Prices may change with 30 days' written notice to active subscribers
• Failed payments may result in service interruption

Cancellation and Refunds

You may cancel your subscription at any time from Settings > Billing. For complete details on the cancellation process, what happens after cancellation, and our refund policy, please see our Cancellation & Refund Policy.

In summary:

• Cancellation takes effect at the end of your current billing period
• You retain full access until the period ends
• No refunds for partial periods (see Cancellation Policy for exceptions)
• Your account and data are preserved — you can resubscribe anytime

Promotional Codes and Discounts

• Promotional codes may be applied at checkout where available
• Promotional discounts apply to the specific billing period(s) indicated
• After the promotional period, your subscription renews at the standard rate
• Promotional codes cannot be combined unless explicitly stated
• We reserve the right to modify or discontinue promotional offers at any time

Referral Program

AviaSkill offers a referral program where existing users can invite others to try the platform:

• How it works: Share your unique referral link. When someone subscribes using your link, both of you receive a discount.
• Referrer discount: 20% off your next billing cycle
• Referred user discount: 20% off their first billing cycle
• Reward cap: Maximum 12 referral rewards per account
• Coupon duration: One-time discount (applies once, then renews at standard rate)

Referral program rules:

• You may not refer yourself by creating additional accounts
• You may not use spam, bulk messaging, or misleading claims to promote your referral link
• We reserve the right to revoke referral rewards and suspend accounts for referral program abuse
• Full referral guidelines are covered in our Acceptable Use Policy

We may modify or discontinue the referral program at any time with notice to active participants.

Free Aviation Tools

AviaSkill provides free aviation tools (crosswind calculator, METAR/TAF decoder, unit converter, and others) that are available to everyone without creating an account.

Terms for free tools:

• Free tools are provided "as is" without warranty — see the Disclaimers section below for full disclaimer
• Tools are for educational and planning reference purposes only — always verify calculations with official sources before making flight decisions
• We may modify, add, or remove tools at any time
• Free tools do not require a subscription and will remain free
• Use of free tools is subject to our Acceptable Use Policy

Acceptable Use

Your use of AviaSkill is subject to our Acceptable Use Policy, which covers:

• What you can and cannot do on the platform
• Account usage rules
• Content and data restrictions
• AI tutor guidelines
• Platform integrity requirements
• Referral program rules

Violations of the Acceptable Use Policy may result in warnings, feature restrictions, account suspension, or termination.

Intellectual Property

Our Content

All content on AviaSkill — including text, graphics, logos, practice questions, study materials, AI-generated explanations, software, and platform design — is the property of AviaSkill or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from AviaSkill content without explicit written permission.

Your Content

You retain ownership of any content you create on our platform (e.g., study notes, bookmarks, chat conversations). By using our Service, you grant us a limited, non-exclusive license to use, store, and display your content solely for providing and improving our Service.

When you delete your account, your content is deleted in accordance with our data retention practices (see Privacy Policy).

FAA Materials

Certain content on AviaSkill is derived from official FAA publications, which are in the public domain as US government works. We do not claim ownership of FAA source materials. However, we hold copyright in our presentation, organization, explanations, and enhancements of such materials.

Feedback

If you provide feedback, suggestions, or ideas about AviaSkill, you grant us an unrestricted, perpetual license to use that feedback for any purpose without compensation to you. You are not required to provide feedback.

AI-Powered Features

AviaSkill uses artificial intelligence (powered by OpenAI) for explanations and the chat tutor. By using these features, you acknowledge that:

• AI is not infallible: AI-generated explanations and responses may occasionally contain errors. Always verify important information with official FAA publications and your CFI.
• No guarantee of accuracy: While we strive for accuracy, AI outputs are provided "as is" without warranty of correctness.
• Data handling: Your interactions with AI features are processed as described in our Privacy Policy.
• Content ownership: AI-generated explanations are part of AviaSkill's content and are subject to our intellectual property terms.
• Usage limits: We may impose reasonable rate limits on AI features to maintain service quality for all users.
• Prohibited use: Do not use AI features for non-aviation purposes, attempt prompt injection, or systematically extract content — see Acceptable Use Policy.

Disclaimers & Limitations of Liability

Educational Tool Only

IMPORTANT: AviaSkill is a study aid and practice tool only. We make no guarantees about exam success, flight certification outcomes, or aviation safety. You are solely responsible for:

• Verifying all information with current FAA publications
• Completing required flight training with a certified instructor
• Meeting all FAA requirements for any certificate or rating
• Your exam performance and certification outcomes
• Any flight decisions you make

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Content accuracy, while diligently pursued, is not guaranteed. This applies to all features, including AI-generated content, practice questions, and free aviation tools.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIASKILL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR REVENUE, LOST DATA, EXAM FAILURE OR CERTIFICATION DENIAL, FLIGHT-RELATED INCIDENTS OR ACCIDENTS, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

Communications

By creating an AviaSkill account, you consent to receive:

Transactional communications (required, cannot be unsubscribed):

• Account verification and password reset emails
• Billing receipts and subscription notifications
• Security alerts and important service updates
• Account deletion confirmations

Product updates (optional, can be unsubscribed):

• New feature announcements
• New certification and tool launches
• Study tips and platform news

You can unsubscribe from product update emails at any time using the unsubscribe link in any email or by contacting support@aviaskill.com. We will never send you emails on behalf of third-party advertisers.

Indemnification

You agree to indemnify, defend, and hold harmless AviaSkill, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms or any related policy
• Your violation of any third-party rights
• Any content you submit through the Service
• Your flight-related decisions based on information obtained from the Service

Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using AviaSkill, you consent to the data practices described in our Privacy Policy.

Changes to the Service & Terms

Service Changes

We may modify, update, suspend, or discontinue any aspect of the Service at any time. We will make reasonable efforts to notify you of significant changes that affect your use of the Service. We are not liable for any modification, suspension, or discontinuation.

Terms Updates

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date
• We will email active account holders about material changes
• We will post a notice on the platform for at least 30 days

Continued use of AviaSkill after changes take effect constitutes acceptance of the updated Terms. If you disagree with changes, you may cancel your subscription and delete your account.

Account Termination

By us: We may suspend or terminate your account and access to the Service for:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent or illegal activity
• Abuse of the Service, other users, or our support team
• Non-payment of subscription fees
• At our reasonable discretion to protect the platform or other users

We will make reasonable efforts to notify you before termination, except where immediate action is necessary.

By you: You may terminate your account at any time by deleting it from Settings > Account. If you have an active subscription, please cancel it first from Settings > Billing.

After termination: Your right to use the Service ceases immediately. Data handling follows our Privacy Policy data retention schedule.

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Informal Resolution First

Before filing any formal dispute, you agree to first contact us at legal@aviaskill.com and attempt to resolve the dispute informally within 30 days.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as otherwise provided in these Terms.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Small Claims Exception

Either party may bring claims in small claims court if the dispute qualifies, as an alternative to arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Cancellation & Refund Policy, constitute the entire agreement between you and AviaSkill regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, government actions, or widespread internet failures.
